Most simply, we call it that because it is – using ordinary English – an accurate and precise description. It is a beacon designed to be worn by a person to emit a signal to locate that person when necessary. Our lawyers and trademark offices around the world have called the phrase “personal locator beacon” a generic description of the device. Having said that, we are of course aware that the first PLBs in the market were satellite based. We do not wish to confuse anyone and, indeed, we wish to distinguish our product from satellite-based PLBs. Thus on our website and on all of our packaging and marketing materials we make it clear that our product is a non-satellite PLB. We even post the following warning: see FAQ’s www.tracme.com “A TracMe Personal Locator Beacon is suitable for use with any activity on land, air, or in waterways. Some situations require a satellite PLB (an EPERB –Electronic Positioning Emergency Radio Beacon, or satellite PLB – Emergency Positioning-Indicating Radio Beacon) to be carried by law. A TracMe Personal Locator Beacon is NOT a substitute for satellite-based beacons in these situations. “ We are also aware that some of our competitors would prefer that we not use the term PLB. But that would be like cable companies that offered the first broadband service claiming that DSL companies and wireless companies could not describe their service as “broadband.” It would, in fact, be misleading not to describe DSL as “broadband.” Similarly, we think it would be misleading to describe TracMe as something other than a personal locator beacon. Frankly, we think some (though not all) of the complaining has to do with competitive concerns rather than legitimate concerns about not misleading consumers. I hope that answers your question.
